DALLAS, April 9 /PRNewswire/ -- Mortgage litigation is growing, according to cases chronicled by http://www.mortgagedaily.com/ -- the dominant source of online news for the mortgage industry.

DLJ Mortgage Capital filed a lawsuit against Sunset Direct Lending seeking nearly $24 million in repurchases, a spokesman for DLJ's parent told MortgageDaily.com. Another suit was filed against Infinity Home Mortgages for $3 million.

Another lawsuit by DLJ for $4 million alleges NetBank failed to forward borrower payments, neglected to pay mortgage insurance and refused to comply with requests for mortgage insurance information, the spokesman said.

ATERAS awarded new conversion

Dallas (ANTARA News/PRNewswire-AsiaNet) - ATERAS announced today that they have been selected by Progressive Casualty Insurance Company for the Policy Number Expansion Project, using DB-Shuttle(TM) Enterprise Change capabilities. Discrimination in Insurance

Testimony on House Bill 247 began at 1:15 a.m. Tuesday morning, March 27th in the House Committee on Insurance. HB 247 would amend the Insurance Code to prohibit discrimination because of sexual orientation or gender identity or expression. Currently, insurers cannot discriminate based on race, color, religion, national origin, age, gender, marital status, geographic location, disability or partial disability. HB 247 would expand the prohibition of discrimination to include sexual orientation and gender identity or expression.

HB 247 is authored by Rep. Roberto Alonzo (D-Dallas), who filed a similar bill in the 2005 Legislative Session. Tuesday's hearing represents the first time testimony has been heard on the bill by the House Committee on Insurance. Equality Texas strongly supports the measure, and helped coordinate testimony from Texans with a personal stake in the legislation.

Consortium of Firms Working on Accutane Litigation

A lawyer representing people who claim that the acne drug Accutane caused them serious gastrointestinal diseases said his team is ready to try cases in Atlantic City, N.J. and Madison County, Ill., in April -- the first two cases of potentially hundreds to go to trial.

Michael D. Hook of Hook Bolton Mitchell Kirkland & McGhee in Pensacola, Fla., who spent 20 years of his legal career mostly defending doctors, hospitals and insurance companies, said that he put together a consortium of firms to take to on Hoffman-LaRoche Inc. of Nutley, N.J.

In the two cases set for trial in April, plaintiff Jason C. Piepart in Madison County alleges that Accutane caused his ulcerative colitis, and Andrew McCarrell in New Jersey had his entire colon removed, Hook said.

In some cases, Hook also is suing doctors whom he claims should have known better than to prescribe Accutane.


Four years but he's free in months

Two people victimized by notorious white-collar criminal William George Kurk are wondering if he's pulled another fast one after getting a four-year prison sentence Friday that will likely see him out in eight months.

"If he was to truly serve four years, that would be adequate," Gerald Aalbers said in an interview. He invested in the now bankrupt company which most recently got Kurk in trouble.

However, Kurk will likely qualify for an "accelerated review" because the 38-year-old Regina man is serving his first stint in a federal prison and for non-violent crimes. (Charges of assault and threatening were stayed in exchange for Kurk's guilty pleas.) An accelerated review means that, by law, the National Parole Board must grant Kurk day parole after he serves one-sixth of his sentence.


Staying with Medicare will help keep it alive

Regular reader Martin Selig of Carle Place reminded me of a warning I had intended to convey about the problems with so-called Medicare Advantage plans.

The deadline for enrollment is March 31. He wondered whether an advertisement for one such plan - Liberty Advantage - isn't intended to "lure people away from government controlled Medicare and put them in the hands of private HMOs." The short answer, of course, is yes.
